Nessel secures injunction to keep USPS Mail-ballot rule in Place

The U.S. First Circuit Court of Appeals rejected the Trump administration’s request to stay a preliminary injunction that halts the mandatory implementation of a United States Postal Service mail-ballot rule for the November 2026 election, according to a statement released by Michigan Attorney General Dana Nessel.

In its decision, the court noted that the district court had found that immediate effect of the Final Rule would cause chaos and widespread disenfranchisement between now and November 3, citing delays in USPS envelope review, lack of an operative portal, and the challenge of scanning tens of millions of ballot envelopes.

Nessel said the court’s ruling protects every eligible Michigander’s constitutional right to vote and that her office remains committed to safeguarding the state’s democratic process.
