Supreme Court decision keeps custody of baby born in Dallas for California parents

On Tuesday, U.S. Supreme Court Justice Elena Kagan rejected a request to intervene in a high‑profile case, allowing a California couple to maintain custody over their biological child born in Dallas via surrogate.

The couple, Nausheen Gilkar and Omar Ahmed, had hired surrogate McKenna West after struggling to have a child. West moved to Texas, gave birth to boy Rumi on Aug. 12, and sought conservatorship. Kagan’s order did not explain why she rejected West’s request.

West’s attorney Lincoln Davis Wilson said the decision confirms parents’ right to provide medical care. The child’s doctor at Children’s Hospital in Dallas testified that Gilkar and Ahmed have agreed to recommended treatment, and Texas courts also ruled against West’s request. The Supreme Court decision keeps the parents’ custody and allows them to bring Rumi back to Los Angeles for care.
