Democratic-led states ask Supreme Court to block mail ballot limits

California and 22 other Democratic-led states urged the Supreme Court on Monday to block President Trump’s plan to impose new federal limits on voting by mail through the U.S. Postal Service.

The states argued that changing mail ballot rules this late in the election year could cause errors and wrongly deny ballots to eligible voters, including voters with disabilities and people in rural areas. They also said the Constitution gives states and Congress, not the president, authority over federal election rules.

Trump’s March 31 executive order directed the Department of Homeland Security to compile state-by-state lists of eligible citizens and told USPS not to transmit mail-in or absentee ballots from people who are not on those lists. A federal judge and the 1st Circuit Court in Boston blocked enforcement this year in the 23 states that sued.

The justices are expected to act within days on whether the administration’s plan may proceed while new guidelines are developed.
