Massachusetts voters face gun law referendum Tuesday

Massachusetts voters are set to decide the fate of a 2024 gun control law in a referendum scheduled for Tuesday, November 3. The measure, known as H.4885, was passed by the state legislature following the Supreme Court's 2022 ruling in New York State Rifle and Pistol Association v. Bruen, which struck down discretionary concealed carry permit systems.

Pro-Second Amendment activists, including the Gun Owners' Action League, collected nearly 100,000 signatures to place the referendum on the 2026 ballot. The law imposes new restrictions on semiautomatic firearms, adds license requirements, and creates specific rules for nonresidents, including temporary carry licenses and registration mandates.

Democratic Governor Maura Healey added an emergency provision in October to keep the law in force pending the vote. Recent polling by the MASSInc Polling Group indicates that 70% of likely Massachusetts voters are inclined to support the measure, which would allow the legislation to remain in effect.
