Kagan warns Supreme Court rulings are destabilizing American democracy

Supreme Court Justice Elena Kagan warned that recent decisions from the conservative-majority court are destabilizing American democracy, stating during a closed discussion at Catholic University Law School that the institution is not working as well as it should.

Kagan cited the 2019 Rucho v. Common Cause decision as the start of a race to the bottom, arguing that the ruling deprived citizens of voting equality and drove the country toward political extremes. She also criticized recent rulings that limited campaign finance restrictions and made it more difficult to draw majority-minority congressional districts.

The remarks come weeks after the Supreme Court began its new term, during which it is expected to rule on major cases regarding gun rights and state election integrity laws. Kagan noted that the court had greater legitimacy during periods of ideological balance, when it was unclear whether the institution could push through any single party's program.
