Supreme Court clears path for Trump mail-voting rules as legal fight continues

The Supreme Court sided with the Trump administration in a challenge brought by Democratic officials from 23 states and Washington, D.C., removing a lower-court injunction that had blocked new procedures for mailed ballots. The justices did not rule on whether the restrictions are constitutional.

The policy would create eligibility lists for mailed ballots and impose new requirements involving voter information, ballot envelopes and postal handling. A nationwide injunction remains in place, and further court decisions could delay, narrow or block the measures before the 2026 midterm elections.

The timing has increased pressure on election officials as states prepare ballots for military and overseas voters. The Election Assistance Commission said about 30% of ballots cast in 2024 were submitted by mail.
