Supreme Court may weigh challenge to federal home-distilling ban

A legal challenge to the federal ban on home distilling has produced conflicting appeals court rulings, increasing the chance that the Supreme Court will consider the case. The Cincinnati-based 6th U.S. Circuit Court of Appeals upheld the law, while the Louisiana-based 5th Circuit ruled that it was unconstitutional.

The challengers argue the ban improperly reaches into private homes and limits individual liberty. The Justice Department says the restrictions, enacted in the 1860s, helped prevent tax evasion. Violations can bring fines of up to $10,000 per batch and as many as five years in prison.
