Supreme Court dismisses challenge to federal mail-ballot rules

The Supreme Court dismissed one of two lawsuits blocking the Trump administration from changing federal regulations on mail-in ballots, ruling 6-3 that the states involved could not show concrete harm. The case challenged an executive order directing the creation of state citizenship lists for voters deemed eligible for mail ballots and prioritizing prosecutions of officials who knowingly allow noncitizen voting.

The court said the order was an internal directive and that any injury to the states depended on future actions that might not occur. Three liberal justices dissented, arguing the states faced a sufficiently concrete and imminent threat and that the ruling left major constitutional questions unresolved.

The regulations remain blocked under a separate nationwide injunction issued by a federal court in Massachusetts. The decision highlighted a continuing divide between the Supreme Court majority and lower courts over federal control of election administration.
