Supreme Court zoning case could reshape religious land-use challenges

The Supreme Court is considering whether an Ohio man could sue over a city zoning dispute before officials issued a final permit denial, a case that could affect how religious groups challenge government regulations nationwide.

Daniel Grand, an Orthodox Jew near Cleveland, received a cease-and-desist notice in 2021 after inviting about a dozen people to his home for a prayer gathering. City officials argue his lawsuit was premature because he withdrew his permit application before the planning commission completed its review.

The case centers on when disputes are ripe for federal court review, not on the merits of the zoning ordinance. Religious groups say governments can burden religious exercise by delaying or extending review processes, while the city says the Supreme Court should not act as a local planning commission.

A decision is expected next year and could influence challenges to policies involving abortion, transgender health coverage and anti-discrimination rules opposed on religious grounds.
